Cameras and Phones – Photos in Public Places

Taking photos in public places? Make sure you have consent.

You are allowed to take photos in public even if other people are in them, but there are some exceptions where you would need the other people’s consent – public spaces such as swimming pools, law courts or areas around schools may have policies regarding use of cameras or video and you should check prior to taking any images.

It is illegal to take photos or videos of another person without them knowing or without their agreement in any place that would be considered private. This includes change rooms and bathrooms.

It is illegal to take, post, send or keep an image of someone under the age of 18 that is a of sexual nature.

It is illegal to take photos or videos of a person’s private activities including those of a sexual nature, or that would be also otherwise considered private, without their knowledge or permission.
